An Analysis of the Book of Laws and Postures

Abstract

By making marriage a sacrament in the twelfth century, the Church sou- ght to extend its moral control over one of the fundamental institutions in shaping the social fabric. In the 13th century, the first Portuguese monarchs legislated on the legality and illegality of matrimonial relations based not only on ecclesiastical mo- rals, but also on the demands of their own society. In this article, then, we analyze some laws gathered in the Book of Laws and Postures, the first legislative effort of the kings of the Burgundian dynasty, which deal with marital unions and barragania, with the aim of understanding how the regulation of marriage was inserted in poli-
tics Portuguese legislation of the 13th and 14th centuries.
